Who is Responsible?
When you are involved in an accident, typically your own insurer is responsible for funding your treatment, reimbursing you for lost wages as a result of the accident, or paying for someone to assist you in your activities of daily living, among other things; these are commonly known as Accident Benefits.
Minor Injury Guideline
As of September 1, 2010, changes to the Statutory Accident Benefits affected how an Insurer may categorize your injuries. Essentially you are placed either inside the Minor Injury Guidelines or outside. When placed within the guideline, the total costs of your medicals and rehabilitation expenses cannot exceed $3500.
For the purposes of this Guideline:
Minor injury means a sprain, strain, whiplash associated disorder, contusion, abrasion, laceration or subluxation and any clinically associated sequelae. This term is to be interpreted to apply where a person sustains any one or more of these injuries.
Our role as your legal representative is to explore your injuries in depth, both physical and psychological, and to determine whether your injuries warrant treatment beyond the Minor Injury Guidelines. We achieve this by speaking with you and doctors/specialists that you receive treatment from, in-depth reviews of medical assessment reports, as well as draw comparisons between your case and precedent case laws in order to demonstrate both subjective and objective evidence to support your claim for Accident Benefits.
A person injured in a car accident and as a result, is substantially unable to resume their normal life is entitled to ONE of the following benefits:
- Income Replacement Benefits – If you are unable to return to work, your insurer will compensate you for time that you missed up to a maximum of 70% of your gross income
- Caregiver Benefits – If you have children or dependents under 16 years of age, or if someone with a disability is under your care, and as a result of the accident you are not able to carry on with your duties, your insurer pays for someone to assist you to the tune of $250 a week for the first dependent, and $50 for each dependent thereafter. (This benefit must have been purchased under your policy prior to the accident)
- Non-Earner Benefits– If you do not qualify for either of the above two benefits, you may be eligible for the Non-earner Benefit. This benefit provides you $185 each week (starting 6 months after the accident) should you not be able to resume a normal life.
In addition to the above benefits, there are other benefits such as Housekeeping, Attendant Care, and Lost of Educational expenses to name a few.
